Client reviews

What couples say

From the firm's website.

“Patrick was extremely helpful and professional throughout our mediation process. He explained every detail thoroughly and guided us through the agreement. He is a kind man who truly tries to be as fair as possible to both parties while educating them on the entire process. We saved a large sum of money on legal fees by choosing mediation with Patrick.”

W.M. · Client testimonial, from the firm's website

“Attorney Morris took a great deal of time explaining the mediation process, answering all of our questions, drawing up the necessary paperwork ... and made himself readily available to us throughout the process.”

L.M.F. · Client testimonial, from the firm's website

“Patrick was a great resource for our uncontested divorce. He explained his role in the mediation process very clearly and described how the divorce process works in detail, all before requesting a fee. Once mediation started he was very helpful in explaining how the Court sees marriage and divorce.”

How it works

Three sessions, one agreement

The free first meeting

You and your spouse meet Patrick together, in Sandwich or by video. He explains the process and the cost and answers every question. Every email after it goes to both of you.

The sessions

Three two-hour sessions. On each issue, the home, the children, support, retirement accounts, Patrick explains the law, and the two of you decide. He makes sure nothing is left out.

Signed and filed

He drafts the separation agreement, you review it, you sign. He e-files the joint petition with the Probate and Family Court, and you attend one short hearing together.

The first meeting

What the first conversation looks like

You and your spouse come in together, or join by video. Patrick asks whether you are both here by choice, then explains what mediation is and what it is not.

He walks through what a divorce has to settle, the home, the children, support, retirement accounts, and answers every question. Nothing is decided yet.

You leave knowing the process, the flat fee and the next date, if you both want to go on.

What you decide

What a mediated divorce settles

The home and the money

Who keeps the house or how it is sold, bank accounts, retirement accounts and pensions, debts, and what each of you brought into the marriage.

The children

Legal and physical custody, the week-to-week schedule, holidays and summers, school and medical decisions, written into a parenting plan.

Child support and alimony

Child support under the Massachusetts Child Support Guidelines, health insurance for the children, and whether alimony is paid, how much and for how long.

The paperwork

The separation agreement, the financial statements and the joint petition, prepared by Patrick and filed with the court for you.

Flat fee

$3,500, the court filing fee included.

Three two-hour sessions, all paperwork and the filing fee, for both of you together. How you split it is up to you.

Questions

Common questions about divorce mediation in Massachusetts

Does mediation work if we do not agree on everything?

That is what it is for. Patrick explains the law on each point, then the two of you talk it through and decide. If one issue stays open, the rest of the agreement can stand and only that issue goes before the judge.

Do we each need our own lawyer too?

No. Patrick is neutral and gives both of you the same legal information, not advice for one side. Either of you may have your own attorney review the draft agreement before you sign. That is your choice, not a requirement.

How long does it take?

Three two-hour sessions, scheduled around your work and the children. The whole mediation usually takes about six weeks.

Is the first meeting free?

Yes. The first meeting is free and confidential, with both of you, at the office in Sandwich or by video. Ask everything you want to know. Nothing starts until you both decide to go on. Call (508) 833-2622.

Barnstable County court

Cape Cod divorces are heard in Barnstable.

Mediation happens at Patrick's table, not in a courtroom. For a couple on Cape Cod, the separation agreement is e-filed with the Barnstable Probate and Family Court, 3195 Main Street, Barnstable, MA 02630, at the county courthouse complex on Route 6A, where the uncontested divorce is heard in one short hearing. Patrick Morris practiced in this court for over 30 years as a divorce attorney. He prepares the two of you for the hearing, and the judge reviews an agreement you wrote yourselves.
